When you visit our stores and locations, access our online presence, or interact with us through websites, social media, email or other digital technology ("Websites"), or when you view our items off - or view, buy or use online, we collect and process information relating to you, which is referred to as personal data.

Barney & Baxter AG are responsible for this privacy statement. These entities are referred to in this document as "we" or "us". You can contact us at the address given at the end of this privacy statement.

 

2. WHAT INFORMATION DO WE COLLECT AND WHY?

 

2.1. To process purchases, provide customer service and other services, and process inquiries

 

2.1.1. Orders, purchases in stores and accounts

 

Online When you purchase an item through one of our websites, or, where available, through one of the digital screens in our stores, we collect your name and business name (if you are a are small businesses), your full postal address and/or separate billing address, your email address, items ordered and returned, delivery information, billing information and other data related to the fulfillment of your order. We also collect data about your use of vouchers (e.g. validity and amount) or gift cards. In addition, data is collected that you make available to us in additional fields, e.g. Your date of birth and phone number.

 

We use this data because it is necessary to process, execute and manage your purchase and to process your order. Please note that in some cases the requested information is mandatory. If you don't give us your name and shipping address, we won't be able to deliver your items.

 

During the purchase process you have the option to set up a personal account. If you choose to do so, we will ask you for additional information, e.g. setting a personal password, your date of birth and your consent to subscriptions to promotional communications.

 

In our store, depending on whether you are a consumer, we collect your name, address and other relevant personal information where necessary to comply with local financial and legal requirements. We may need this information to provide you with a refund or a sales receipt (VAT receipt). This data is collected through our point of sale in store.

 

In addition, some of our stores offer the option of picking up or returning items you have ordered online from one of our selected stores. In order to be able to offer you these services, we process your personal data such as your e-mail address in order to send you information about your order. For example, when your order is ready for collection. In addition, our branch employees register whether you have picked up or returned an order.

2.1.4. Checking for fraudulent credit card use and excessive credit card charges

 

If you choose to pay for your order by credit card, we will conduct a credit check to determine if your personal information is associated with fraudulent credit card use or excessive credit card charges. For this purpose, our payment service provider uses your name and bank details. We ourselves do not collect any information regarding the payment instrument you use, e.g. credit card information. This information is processed exclusively by our payment service provider and payment instrument providers, who are subject to strict information security measures. We conduct this check to protect our legitimate business interests, to prevent fraud and financial loss, or to comply with our legal obligations.

Based on your online and offline purchase history, your behavior on websites (pages visited, links clicked) and interaction with chatbots, we create and maintain your personal digital marketing profile to ensure that we only show you the advertisements that that best suits your personal taste. This is known as targeted advertising. The more successful we are with targeted advertising, the higher our (potential) customer satisfaction.

 

In order to show you targeted advertising, we may also match your data profile with customers who have a similar profile.

 

To support our targeted advertising, we use a data management platform (“DMP”).

 

DMP information provides insight into how our consumers are responding to our brand, products and advertising. This information is collected from various sources available to us offline, online and mobile, e.g. B. when you visit our website. In addition, they are enriched with information collected by other providers, e.g. B. with data on the local weather. Based on this information, the DMP can help our marketing teams find and define relevant segments of online audiences to target marketing campaigns within Tommy Hilfiger's digital channels and beyond. 2.2.4. Entering a sweepstakes, contest, seasonal or other promotion

 

We may offer you the opportunity to enter a sweepstakes, contest or other (in-store) promotion. Some of these promotions include additional rules that provide information about how we use and disclose your personal information.

 

We collect information that is necessary for you to be able to participate in the activity and that allows us to manage our contractual relationship with you, e.g. Your name and email address. Personal information we collect as part of a sweepstakes, contest, seasonal or other promotion may be subject to additional privacy notices.

To enable us to do this, we have engaged third parties to provide social listening services. Please note that any information you post or disclose through these Services will become public and may be available to other users and the public.

 

Also, if you disclose personal information relating to other individuals to us or our related service providers, you represent that you have the authority to do so and permit our use of the personal information in accordance with this Privacy Policy. When you connect your social media account to your Tommy Equestrian account (where this feature is available), you share certain personally identifiable information from your social media account with us, e.g. Your name, email address, photo, list of your social media contacts and any other information that may be available to us or that you provide to us when you link your social media account to your Connect Tommy Equestrian Account. With your consent or where we have a legitimate interest, we will engage in these activities to manage our contractual relationship with you.

 

2.3. To improve our services and products

 

We process your personal data across websites to identify usage trends and provide personalized content (e.g. articles, size recommendations). The information we collect is used to further improve our services and items, for example to create and design our new collection or to make improvements to current collections to meet your expectations.

 

For example, if you actively talk about us or our brands on social media, or interact with our chatbot or customer service, we may use your contributions to improve our services and items. We will engage in this activity when we have a legitimate interest.

 

2.4. In connection with a sale or business transaction

We use the services of Klar (Klar Insights GmbH, Marktstr. 18, 80802 Munich, Germany) on our website. Klar, collects, processes and stores data on this website and its subpages for reach measurement, statistical analysis. This collection takes place on the following legal basis:
